With Data Recorders, Big Brother is Riding Shotgun

Many people have reservations about OnStar due to the intrusive
nature of the service. To avoid any intrusion, people can simply
not subscribe to OnStar; what people cannot do is uninstall the
mechanism in your vehicle that feeds OnStar your driving
information. This mechanism is called an “Event Data Recorder (EDR).”
The EDR continuously collects data pertaining to your driving
movements and can store this info for up to 45 days. EDR data can
give law enforcement officials critical insight into causes of
accidents. But in doing this is it also infringing on the privacy
of the motorist?

A provision relation to customer records may be struck down
soon, but don’t take any chances.
On September 29, 2004, the N. Y. Federal District Court
invalidated an important provision of the U.S. Patriot Act. The
major issue at hand is when to inform your subscribers of a
governmental inquiry into their records and when it is illegal to
do so. As a precautionary measure, make sure you and your counsel
understand this development and how it relates to your companies
