Room 259
The Role of the Prosecution: The Moral, Legal and Ethical Burdens of Maintaining Public Confidence in the Administration of Justice – “A Canadian Perspective”
CLE Credits: 2.0 (applied for)
This lecture will provide a frank and in-depth discussion of the ethical issues which arise in the role of the prosecution within the criminal trial process. What is “Prosecutorial Discretion” and what is the interplay of this discretion in the criminal trial process: from involvement in the initial stages of investigation to the strategic decisions made throughout the trial process. What responsibility must the “Office of the Prosecution” take in maintaining public confidence in the administration of Justice, by ensuring a fair, unbiased, and transparent process? What does success look like? What are the red flags, which, if ignored, lead to failure?
Crown Prosecutor Karen Hewitt will offer a Canadian comparative perspective to these problems that the U.S. and Canada both deal with. Ms. Hewitt has held both designations of Agent for the Attorney General of Alberta and Agent of the Attorney General of Canada. Over her 15 years as a Crown Prosecutor, she has prosecuted a wide range of criminal cases, many of which have generated precedent setting decisions across Canada and resulting legislative changes to the Criminal Code.
Currently, as a member of the Special Prosecutions Branch, Ms. Hewitt is vested with the prosecution of serious, complex and high profile cases for the Attorney General of Alberta. She also holds a designation as a Wiretap Agent and corresponding expertise in providing legal advice and direction to the police on issues involving the interception of private communications.
As an Organized Crime Prosecutor, Ms. Hewitt is part of a designated team of prosecutors responsible for working with law enforcement agencies and other prosecutors (provincially, nationally and internationally) on operational issues related to organized crime: providing advice on investigations, conducting prosecutions and providing educational assistance where requested – with the object of dismantling and disrupting organized crime activity in the Province of Alberta.

This program will focus on Parent-Child Alienation, with an emphasis on both psychological and structural intervention. The seminar will review the definition, diagnosis, and characteristic behaviors of the alienated child, the alienating parent, the rejected parent, and tribal warfare, and the effects of alienation on children.
The program will then focus on what to do, both in terms of structural and psychological interventions to manage or ameliorate the negative impacts of alienation of the child. There will be a review of current research, and present case material to illuminate the problem of alienation. In addition, there will be discussion on the ethical responsibilities of the professionals working with alienating parents and a discussion of whether alienation is child abuse.
